CORNELIUS, N.C., Sept. 03, 2026 (GLOBE NEWSWIRE) -- U.S. advertisers are expected to spend $71.09 billion on retail media in 2026.1 Alpha Modus Holdings, Inc. (NASDAQ: AMOD) today announced that the United States Patent and Trademark Office has issued U.S. Patent No. 12,725,176 to its subsidiary, Alpha Modus, Corp., covering how a shopper's behavior inside a physical store becomes a priced, personalized offer delivered to that shopper's phone.
The patent, titled "Method for Personalized Marketing and Advertising of Retail Products," is the company's 13th granted U.S. patent. Its priority chain runs back to a provisional application filed in July 2013, years before retail media networks became a standard line item in brand budgets.
What the Patent Covers
The claims describe a two-system method. One system watches what a shopper actually does with products in a store. A second system determines where that shopper is and delivers the offer. Specifically, the patent covers the ability to:
- Identify the products a shopper is engaging with by tracking their position at the shelf, tracking their eye movements, or capturing a direct interaction with a kiosk, display, tablet, or phone
- Build an information analysis of that shopper's activity, including demographic and sentiment data
- Hand that analysis to a separate tracking system that determines where the shopper is located
- Deliver a personalized product communication to a mobile device, kiosk, or sales associate, covering price, in-store product placement, advertising content, printed or digital coupons, and limited-time price reductions
- Present more than one store location where the product can be purchased, along with the price at each location
- Route the resulting purchase to shipping or to in-store pickup
The mechanism sits at the center of how first-party in-store data gets monetized. A retailer or brand observes behavior at the shelf and turns it into a specific offer, at a specific price, at a specific store, on the device the shopper is already holding.
"Retail media spent a decade learning how to talk to shoppers online. The hard part was always the store," said William Alessi, Chief Executive Officer of Alpha Modus Holdings, Inc. A Robust and Defensible Portfolio
Alpha Modus now holds 13 granted U.S. patents with one application pending. The portfolio covers real-time consumer behavior analysis, personalized in-store marketing, shelf and planogram intelligence, inventory management, and customer assistance. As previously announced, the company defeated a motion to dismiss brought by MNTN in August 2026.
